1.1. This motor vehicle subscription agreement (the "Agreement") is a legally binding contract between Scooturu Rentals ("we," "us," "our") and you ("Subscriber," "you," "your"). By entering into this Agreement, you acknowledge that you have read, understood, and agreed to abide by all terms and conditions set forth herein.
1.2. This Agreement consists of the following documents, which together govern your rights and obligations as a Subscriber:
These Subscription Terms and Conditions;
Your Subscription Application (including Subscription Details and Subscription Plan);
The Vehicle Condition Report.
1.3. You agree to provide complete, accurate, and up-to-date information when completing your Subscription Application, including but not limited to:
Proof of identity;
A valid driver’s license issued by a recognized authority;
Evidence of current residential address;
Proof of employment and/or income, if requested;
Bank account or valid payment method details.
1.4. This Agreement shall be governed by and construed in accordance with the laws of the State or Territory in which the Vehicle is provided. The courts of that jurisdiction shall have non-exclusive jurisdiction over any disputes arising from or relating to this Agreement.
1.5. The provisions of the Australian Consumer Law apply to this Agreement and afford you rights that cannot be excluded, restricted, or modified.
1.6. You acknowledge and agree that electronic signatures are valid and enforceable as a means of accepting this Agreement.
In addition to the subscription rates applicable to your selected plan, you acknowledge and agree that the following additional fees and charges may be incurred:
Toll Processing Fee: $3.99 per day (includes toll fee, number plate recognition fee, and administration fee).
Late Payment Fee: $10.00 for invoices that remain unpaid for more than seven (7) days beyond the due date.
Infringement Notice Fee: $25.00 per infringement notice processed by Scooturu Rentals.
Credit/Debit Card Transaction Fees:
Domestic cards: 2.00% per transaction.
International cards: 3.00% per transaction.
Bank direct debit: 1.00% (capped at $3.50).
Payment Dispute Fee: $25.00 per unfounded chargeback, plus any processing fees imposed by third-party payment processors.
Lost/Stolen/Damaged Phone Holder: $15.00
Lost/Stolen/Damaged Helmet: $120.00
Lost/Stolen/Damaged Key: $100.00
Replacement Tyre: $65.00 (full replacement) / $25.00 (puncture repair)
Battery Replacement: $25.00
Refuelling Fee: $25.00 (applies if the Vehicle is returned with less than a full tank of fuel).
Excess Reduction Fee (reducing liability from $1500 to $500): $15.00 per week
Combo Delivery Bag & Rack: $15.00 per week
Additional Helmet: $15.00 per week
Additional Driver (including helmet & insurance): $20.00
Additional Delivery Rack: $10.00
Additional Delivery Bag: $10.00
Missed Appointment Fee: $55.00
Overdue Service Fee: $25.00 for every 1,000 km driven beyond the required service interval.
Absence at Vehicle Return: If you are not present at the agreed time and location for the return of the Vehicle, we reserve the right to impose a fine or recover additional administrative costs.
Stolen Vehicle Excess: In the event of theft of the Vehicle while under your control, you will be liable for an excess charge of $1500.
Damage Assessment and Repairs: If the Vehicle sustains damage requiring parts replacement or repairs, all costs shall be assessed and quoted solely by Scooturu Rentals.
For minor cosmetic damage such as scratches, we reserve the exclusive right to evaluate and determine the extent of the repair costs at our discretion.
3.1. By submitting a Subscription Application, you expressly authorize us to conduct verification checks, including but not limited to identity confirmation, credit history assessment, and validation of driving records.
3.2. You must provide and maintain accurate personal, financial, and contact details throughout the subscription period.
3.3. Eligibility Criteria: To qualify for a subscription, you must:
Be at least 18 years old and not over 75;
Have no less than one (1) year of verifiable driving experience;
Hold a valid Australian or international driver’s license, with a certified translation if not in English;
Not have had your license cancelled or suspended in the past three (3) years;
Not have been convicted of any criminal, drink-driving, or drug-related offenses within the last five (5) years;
Not have made two or more motor insurance claims in the past three (3) years.
3.4. You must notify us immediately if any of the following occur:
Change of address, phone number, or email;
Modification of your nominated payment method;
Suspension, cancellation, or restriction of your driver's license.
4.1. Authorized Drivers: Only the Subscriber and any Authorized Driver listed in the Agreement may operate the Vehicle.
4.2. Prohibited Uses: The Vehicle must not be used:
While under the influence of alcohol or drugs;
In a reckless or dangerous manner;
To transport illicit goods or passengers for hire;
Off-road, on beaches, through floodwaters, or outside the Australian mainland;
To tow, push, or propel another vehicle or trailer.
4.3. Vehicle Care and Maintenance:
The Vehicle must be securely locked when unattended;
The correct fuel type must be used at all times;
Smoking or the transport of animals (except certified service animals) is strictly prohibited;
Scheduled servicing must be adhered to. Failure to do so may result in liability for full repair costs in the event of a mechanical failure linked to overdue maintenance.
5.1. Standard Damage Cover: The subscription includes standard insurance coverage with an excess of $1500, which applies in all instances of accident, damage, or theft unless otherwise stated.
5.2. Excess Reduction: Subscribers may opt for a $15 per week fee to reduce the excess to $500, including for theft.
5.3. Exclusions:
Damage arising from a Major Breach of the Agreement;
Damage to underbody, overhead areas, or caused by immersion in water;
Loss or damage to personal items left inside the Vehicle;
Damage caused due to negligence, misuse, or operating the Vehicle in violation of this Agreement.
5.4. Liability for Damage: If the Vehicle sustains damage requiring repairs or part replacements, all costs shall be assessed and quoted solely by Scooturu Rentals. The company reserves the exclusive right to determine the extent of the repair costs for minor cosmetic damages such as scratches.
5.5. Theft or Total Loss: In the event of theft or total loss of the Vehicle:
The Subscriber is responsible for the full insurance excess unless the excess reduction option was selected;
If the Vehicle is not recovered, Scooturu Rentals will determine the settlement procedure based on market value and damage assessment.
6.1. To qualify for a Subscription, you must meet all of the following requirements:
Be at least 18 years of age and not over 75;
Have at least one (1) year of valid driving experience;
Hold a valid driver’s license issued in an Australian state or territory or a recognized international license (with a certified translation if required);
Your license must not have been cancelled or suspended within the past three (3) years;
You must not have been convicted of any criminal, drink-driving, or drug-related offenses in the past five (5) years;
You must not have made two or more motor insurance claims within the past three (3) years;
You must not be bankrupt or have been bankrupt within the last seven (7) years.
6.2. You must provide all necessary supporting documents, including but not limited to:
Proof of identity;
Proof of current residential address;
Valid payment method details;
Any additional verification documents requested by Scooturu Rentals.
6.3. You must immediately notify us if:
Your contact details (address, phone number, email) change;
Your nominated payment method is modified;
Your driver’s license is suspended or cancelled;
Any other material changes occur that may affect your eligibility for the Subscription.
7.1. It is a fundamental condition of this Agreement that you:
Pay all Subscription Charges via the nominated payment method when they become due;
Ensure that only an Authorized Driver operates the Vehicle;
Maintain a valid driver’s license at all times during the Subscription Period.
7.2. Subscription Term:
The Subscription Agreement is active for the duration of your Subscription Plan.
Some plans may include a minimum commitment period, during which you are not permitted to terminate the Subscription.
If no minimum commitment applies, the Subscription remains active until terminated in accordance with this Agreement.
7.3. Termination by the Subscriber:
You may terminate the Agreement by providing at least seven (7) days' written notice.
No refund will be issued for any Subscription Charges already paid if you terminate before the end of a billing cycle.
7.4. Termination by Scooturu Rentals:
We may terminate the Agreement at any time by providing seven (7) days' written notice.
If we terminate without cause, you will be refunded any unused portion of your Subscription Charges.
If termination is due to a Major Breach of the Agreement, no refund will be issued, and additional charges may apply.
7.5. Immediate Termination:
Scooturu Rentals reserves the right to terminate your Subscription immediately if:
You commit a Major Breach of the Agreement;
You fail to pay outstanding Subscription Charges;
You provide false or misleading information during the Subscription Application process.
8.1. Once your Subscription Plan is approved, you may select a Vehicle and confirm your Booking start date.
8.2. Each Booking is subject to these Terms and Conditions, and you must strictly adhere to the dates, times, and conditions outlined in your Subscription Plan.
8.3. Minimum Subscription Period & Early Return Fee:
If your Subscription Plan includes a minimum commitment period, returning the Vehicle before this period ends may result in an Early Return Fee.
The Early Return Fee is calculated based on the remaining duration of your minimum term.
8.4. Booking Confirmation & Vehicle Allocation:
A confirmed Booking does not constitute a lease, nor does it grant you ownership rights over the Vehicle.
Scooturu Rentals reserves the right to decline activation of a Subscription at its discretion.
We may reallocate a Vehicle before you collect it if necessary for operational reasons.
8.5. Modifications & Cancellations:
You may request to modify or cancel your Booking by providing written notice at least 24 hours in advance.
Approval of modifications is at our sole discretion, and additional charges may apply.
If you fail to collect the Vehicle at the agreed time, we reserve the right to cancel your Booking without a refund.
9.1. Vehicle Collection:
The Subscriber must collect the Vehicle at the agreed location and time as specified in the Subscription Agreement.
A valid driver’s license and proof of identity must be presented at the time of collection.
If the Subscriber fails to collect the Vehicle within the agreed timeframe, Scooturu Rentals reserves the right to cancel the Subscription without refund
The presence of the renter is mandatory at the time of delivery. If the renter is not present at the agreed time and location,
Scooturu Rentals reserves the right to retain the bond and/or apply penalties.
9.2. Vehicle Condition Report:
Before taking possession of the Vehicle, the Subscriber must complete and sign the Vehicle Condition Report (VCR), which records the current condition of the Vehicle, including any existing damage.
The Subscriber must verify all listed damages and ensure they match the actual condition of the Vehicle before signing the VCR.
Any discrepancies must be reported before leaving the collection site.
9.3. Pre-existing Damage:
Any damage noted in the Vehicle Condition Report shall not be considered the responsibility of the Subscriber.
If the Subscriber fails to complete the VCR, they will be deemed to have accepted the Vehicle in its existing condition.
9.4. Failure to Report New Damage:
The Subscriber is responsible for all unreported damage found at the time of return that was not recorded in the VCR.
9.5. Mobile Delivery Service:
If the Subscriber requests a mobile delivery, they are required to be present at the agreed delivery location.
10.1. The Subscriber must operate the Vehicle in a responsible and lawful manner, adhering to:
All traffic laws and regulations;
The terms outlined in this Agreement;
The guidelines provided by Scooturu Rentals regarding proper use and maintenance.
10.2. Restricted Areas & Conditions:
The Vehicle must not be driven:
Outside Australia;
On unsealed roads, beaches, or off-road terrain;
Through floodwaters or hazardous conditions.
10.3. Towing & Modifications:
The Subscriber is strictly prohibited from:
Towing trailers or other vehicles;
Attaching external modifications (e.g., roof racks, stickers, or alterations to the engine or exhaust system);
Using the Vehicle for racing, stunts, or other extreme driving activities.
10.4. Passenger & Cargo Limitations:
The Vehicle must not exceed the manufacturer’s recommended passenger or weight capacity.
The Subscriber is responsible for ensuring that all passengers wear appropriate safety equipment, including helmets where required.
10.5. No Unauthorized Subletting or Lending:
The Subscriber is prohibited from subletting, hiring out, or lending the Vehicle to any third party who is not an Authorized Driver under this Agreement.
Any breach of this clause will result in immediate termination of the Subscription.
11.1. Routine Maintenance:
The Subscriber must ensure the Vehicle undergoes routine maintenance at the intervals specified by Scooturu Rentals.
Maintenance includes, but is not limited to: oil changes, brake inspections, tire rotations, and general servicing as per the manufacturer’s recommendations.
The required service intervals are noted under the seat inside the seat compartment of the Vehicle.
Servicing is mandatory, and failure to comply may result in additional fees, loss of damage cover, and full liability for any resulting mechanical issues.
The Subscriber must report any warning lights or unusual noises immediately to Scooturu Rentals.
11.2. Repairs and Unauthorized Modifications:
The Subscriber is strictly prohibited from performing or authorizing repairs, modifications, or mechanical work on the Vehicle without prior written approval from Scooturu Rentals.
Any unauthorized repair or modification will result in the Subscriber being fully liable for all associated costs, including any additional damage caused.
11.3. Mechanical Failures and Roadside Assistance:
Scooturu Rentals provides roadside assistance for breakdowns not caused by misuse, negligence, or overdue servicing.
If the mechanical failure is determined to be due to overdue maintenance caused by the Subscriber, the Subscriber will be liable for the full repair cost.
11.4. Damage Due to Negligence:
If damage to the Vehicle is caused by the Subscriber’s failure to comply with maintenance requirements, Scooturu Rentals reserves the right to charge the full cost of repairs and associated downtime.
12.1. Liability for Tolls:
The Subscriber is responsible for all toll charges incurred during the Subscription Period.
Tolls are processed automatically through the Vehicle’s registered toll account and charged to the Subscriber accordingly.
12.2. Toll Processing Fee:
A processing fee of $3.99 per day applies to cover administrative and system costs related to toll transactions.
12.3. Unpaid Tolls & Penalties:
If toll charges remain unpaid due to insufficient funds or failed payments, a late toll processing fee of $10 per instance will be charged.
Any government-issued toll fines or penalties due to non-payment will be passed directly to the Subscriber, along with an additional $25 administrative fee per infringement.
12.4. Alternative Toll Payment Methods:
If the Subscriber wishes to use a personal toll account, they must provide Scooturu Rentals with the toll account details prior to collecting the Vehicle.
The Subscriber remains liable for any missed toll payments even when using a personal toll account.
13.1. Scope of Cover:
The Subscriber is provided with a standard insurance policy that covers damage to the Vehicle and third-party property, subject to an excess fee.
The default excess fee is $1500, which applies to any claim unless an excess reduction option has been selected.
If the Subscriber has opted for the excess reduction option ($15 per week), the excess payable in case of damage or theft is reduced to $500.
13.2. What is Covered:
Accidental damage to the Vehicle while in use by the Subscriber or an Authorized Driver.
Damage caused by a third party, provided that the Subscriber provides sufficient details of the responsible party for an insurance claim.
Theft or attempted theft of the Vehicle, provided that the Subscriber was not negligent (e.g., keys left in the Vehicle).
13.3. Obligations in Case of Damage:
The Subscriber must immediately report any accident, theft, or damage to Scooturu Rentals.
A Damage Report Form must be completed within 24 hours of the incident.
Failure to comply with these reporting requirements may result in the Subscriber being liable for the full repair or replacement costs.
14.1. Exclusions from Insurance Cover:
The Subscriber will be fully liable for all damages if any of the following occur:
The Vehicle was driven by an unauthorized person.
The damage resulted from reckless or dangerous driving.
The Vehicle was used for off-road driving, racing, or illegal activities.
The damage was caused due to flooding, immersion in water, or driving through hazardous conditions.
The Subscriber failed to report an accident or theft within the required 24-hour period.
14.2. Specific Damage Not Covered:
Any overhead, underbody, or interior damage that was not caused by an accident involving another party.
Tire punctures or wheel damage unless caused by a collision.
Lost or stolen personal belongings inside the Vehicle.
Any damage caused while the Subscriber was under the influence of drugs or alcohol.
14.3. Financial Responsibility for Excluded Damages:
If the damage is excluded from insurance cover, the Subscriber will be charged the full cost of repairs and associated administrative fees.
The amount payable will be determined by an independent repair quote arranged by Scooturu Rentals.
15.1. Return Location and Time:
The Subscriber must return the Vehicle to the agreed location at the agreed time and date as stated in the Subscription Agreement.
If the Subscriber fails to return the Vehicle on time, late return fees may apply.
The presence of the renter is mandatory at the time of return. If the renter is not present at the agreed time and location,
Scooturu Rentals reserves the right to retain the bond and/or apply penalties.
15.2. Condition Upon Return:
The Vehicle must be returned in the same condition as when it was collected, subject to fair wear and tear.
A final Vehicle Condition Report (VCR) will be completed upon return to assess any new damages.
Any unreported damages that were not present at the start of the Subscription will be charged to the Subscriber.
15.3. Cleaning and Fuel Requirements:
The Vehicle must be clean upon return; otherwise, a cleaning fee may apply.
The Vehicle must be returned with a full tank of fuel unless otherwise agreed. If not, a refuelling fee of $25 will be charged.
15.4. Missed Return Appointment:
If the Subscriber is not present at the scheduled return time, Scooturu Rentals reserves the right to charge a no-show fee.
If the Vehicle is not returned within 24 hours of the scheduled time and no prior notice is given, Scooturu Rentals may remotely disable and repossess the Vehicle at the Subscriber’s expense.
If a mobile pick-up service is arranged, the Subscriber remains fully liable for the scooter until the pick-up has been completed and confirmed by Scooturu Rentals.
16.1. Subscription Payments:
The Subscriber agrees to pay all Subscription Charges in accordance with the billing schedule outlined in the Subscription Agreement.
Payments must be made via the nominated payment method.
Failure to make payments on time may result in late fees, service suspension, or termination of the Subscription.
16.2. Additional Fees and Charges:
The Subscriber is responsible for all applicable additional fees as outlined in this Agreement, including but not limited to:
Late payment fees;
Toll processing fees;
Damage and repair costs;
Cleaning and refuelling fees;
Missed return appointment fees.
16.3. Payment Disputes:
If the Subscriber disputes any charge, they must notify Scooturu Rentals within 7 days of the charge being applied.
Disputes must be submitted in writing, including supporting documentation.
While the dispute is under review, the Subscriber must continue making all required payments. Failure to do so may result in Subscription suspension or termination.
16.4. Unpaid Balances and Debt Collection:
Any unpaid balances remaining after 14 days may be referred to a debt collection agency, and the Subscriber will be responsible for any additional recovery costs.
Scooturu Rentals reserves the right to report outstanding debts to credit reporting agencies, which may affect the Subscriber’s credit rating.
17.1. Roadside Assistance:
Roadside assistance is included for mechanical breakdowns that are not caused by misuse or negligence.
If the breakdown is determined to be due to Subscriber negligence, the Subscriber will be charged for the full cost of repairs and towing.
17.2. What is Covered:
Towing to the nearest authorized repair center if the Vehicle is inoperable due to a mechanical failure.
Assistance with flat tires, battery jump-starts, and lockouts, provided they are not due to the Subscriber’s fault.
17.3. Subscriber Responsibilities:
The Subscriber must immediately report any breakdown to Scooturu Rentals.
The Subscriber must not attempt to repair the Vehicle themselves or use unauthorized repair services.
17.4. Costs Not Covered:
If the breakdown is caused by misuse, negligence, or overdue servicing, the Subscriber will be responsible for all associated costs.
Any unauthorized towing or roadside assistance will not be reimbursed by Scooturu Rentals.
18.1. Reporting an Accident:
The Subscriber must immediately report any accident to Scooturu Rentals and provide full details, including:
Date, time, and location of the accident;
Details of all involved parties, including witnesses;
Photos of the scene and damage.
A Damage Report Form must be completed within 24 hours of the accident.
18.2. Theft or Vandalism:
If the Vehicle is stolen or vandalized, the Subscriber must immediately notify the police and obtain a police report.
The police report must be provided to Scooturu Rentals within 24 hours.
18.3. Subscriber’s Liability:
If the Subscriber fails to report an accident or theft within the required timeframe, they may be held liable for the full cost of repairs or replacement.
If the Vehicle is stolen due to the Subscriber’s negligence (e.g., leaving the keys inside the Vehicle), the Subscriber will be responsible for the full loss.
18.4. Insurance Claim Process:
Scooturu Rentals will process any valid insurance claims, and the Subscriber will be required to pay the applicable insurance excess as outlined in the Agreement.
If the insurance company denies the claim due to the Subscriber’s actions, the full repair or replacement cost will be charged to the Subscriber.
19.1. Grounds for Repossession:
Scooturu Rentals reserves the right to repossess the Vehicle without prior notice if:
The Subscriber fails to make timely payments;
The Vehicle is used in violation of the Terms & Conditions;
The Vehicle is reported stolen or involved in illegal activities;
The Subscriber fails to return the Vehicle at the agreed time and location;
There is reasonable suspicion that the Vehicle is being misused, abused, or may be at risk of damage or loss.
19.2. Process of Repossession:
If repossession is required, Scooturu Rentals may:
Remotely disable the Vehicle to prevent further use;
Recover the Vehicle from any location, with or without the Subscriber’s presence;
Involve law enforcement if necessary.
19.3. Subscriber Liability:
The Subscriber will be liable for all repossession costs, including towing, administrative fees, and outstanding Subscription charges.
If repossession occurs due to non-payment, the Subscriber must settle all outstanding debts before being considered for future rentals.
20.1. Definition of a Major Breach:
A Major Breach includes, but is not limited to:
Failure to comply with payment obligations;
Operating the Vehicle under the influence of alcohol or drugs;
Using the Vehicle for illegal purposes;
Reckless driving resulting in serious damage or injury;
Allowing an unauthorized person to operate the Vehicle;
Failure to return the Vehicle within 24 hours after the end of the Subscription.
20.2. Penalties for a Major Breach:
If a Major Breach occurs, Scooturu Rentals may:
Terminate the Subscription Agreement immediately;
Remotely disable the Vehicle to prevent further use;
Charge the full repair or replacement cost of the Vehicle if damage occurs;
Report the Subscriber to credit agencies for unpaid balances.
20.3. Legal Action & Recovery:
In cases of theft, fraud, or intentional damage, Scooturu Rentals reserves the right to pursue legal action.
The Subscriber may be held responsible for all legal and recovery costs incurred.
21.1. Collection of Personal Information:
By entering into this Agreement, the Subscriber consents to the collection, use, and storage of personal information by Scooturu Rentals.
Information collected may include, but is not limited to:
Name, address, and contact details;
Driver’s license and identification details;
Payment information and transaction history;
GPS tracking data from the Vehicle.
21.2. Use of Personal Information:
Scooturu Rentals may use personal information for:
Managing the Subscription and processing payments;
Verifying identity and eligibility for a Subscription;
Monitoring Vehicle location and usage for security and operational purposes;
Complying with legal and regulatory requirements.
21.3. Disclosure of Information:
Scooturu Rentals may disclose personal information to:
Law enforcement authorities in case of legal violations;
Insurance companies in the event of an accident or claim;
Debt collection agencies for unpaid balances;
Service providers for maintenance, toll processing, or roadside assistance.
21.4. Data Protection:
Scooturu Rentals implements appropriate security measures to protect personal data from unauthorized access, loss, or misuse.
The Subscriber has the right to request access to their personal information and request corrections if necessary.
22.1. Agreement – Refers to the Scooturu Rentals Subscription Agreement, including these Terms & Conditions and any additional documents referenced herein.
22.2. Authorized Driver – A driver who has been approved by Scooturu Rentals and listed on the Subscription Agreement.
22.3. Damage Cover – The insurance protection included in the Subscription, subject to the applicable excess and exclusions.
22.4. Excess – The portion of repair or replacement costs payable by the Subscriber in the event of an insurance claim.
22.5. Major Breach – A violation of this Agreement that may result in termination of the Subscription and additional financial liability.
22.6. Repossession – The act of Scooturu Rentals reclaiming the Vehicle due to non-compliance with the Agreement.
22.7. Subscription Charges – The fees payable by the Subscriber for the use of the Vehicle, including recurring payments and additional costs.
22.8. Vehicle – The motor vehicle provided by Scooturu Rentals under the Subscription Agreement.
22.9. Vehicle Condition Report (VCR) – The documented assessment of the Vehicle’s condition at the time of collection and return.

You will be charged a Dishonour Fee by MFA and You (or, if relevant, the Nominated Card Holder) may be charged fees, charges and interest by Your financial institution or, if relevant, the financial institution of the Nominated Card Holder.
Payment by MFA Corporate Account Holder
You must immediately provide MFA with updated or alternate payment method details if the MFA Corporate Account is cancelled or altered or if You are no longer authorised to incur Tolls and Fees on that MFA Corporate Account.
Failure to pay Tolls and Fees
and MFA may notify the Rental Co of any such action by MFA.
In these MFA Terms and Conditions, except where the context otherwise requires:
"Administration Fee" means $2.20 per toll invoice incurred after 14 days of non-payment, or $25 per toll invoice incurred after 30 days of non-payment (including a legislated fine of $180, where applicable).
"Authorised Driver" means each "Authorised Driver" specified in Your Rental Agreement.
"Authorised Representative" means an individual who is 18 years or older and who is authorised by You to use and access Your eFleetPass Service.
"Carbon Offset Levy" means a fee of $[0.25].
"Credit Reporting Agency" means a corporation that carries on a credit reporting business.
"Dishonour Fee" means a fee of $1.15.
"Drive Now Pay Later" or "DNPL" means the drive now pay later method of payment which may be selected by You through the eFleetPass System for the payment of specific Tolls and Fees;
"Electronic Tolling Lane"means a Tolling Lane which is designated as permitting the payment of Tolls by electronic means.
"eFleetPass Service" means the facility described in clause 1(a).
"eFleetPass System" means the entire system relating to electronic tolling operated by MFA, any operator of a toll road or any Tag Issuer or Pass Issuer.
"Feed-in Levy (Tariff)" denotes a data transmission charge associated with the secure exchange of tolling data from the NSW transport data server to MFA Motorways' data processing infrastructure. This ensures secure, encrypted handling of financial data, supporting accurate and reliable tolling operations for drivers and rental companies.
"Fees" means each of the fees and costs (and any taxes applicable to them) described in clauses 2(a)(ii) - 2(a)(v) inclusive of these MFA Terms and Conditions.
"GPS Tracking Levy" means a fee of $0.50 per Toll transaction
"GST" has the same meaning as in A New Tax System (Goods and Services Tax) Act 1999 (Cth).
"MFA Corporate Account" means a charge account established by a person with MFA for the payment of Tolls and Fees.
"MFA Corporate Account Holder" means the person with whom the MFA Corporate Account has been established.
"MFA Terms and Conditions" means these MFA Terms and Conditions which comprise the "MFA eFleetPass Service Terms and Conditions" and the "MFA Privacy Consent and Agreement".
"Nominated Card" means a valid credit card or MasterCard or Visa branded debit card nominated by You as the source of payment for all Tolls and Fees.
"Nominated Card Holder" means a person other than You who holds a Nominated Card.
"Pass Issuer" means a toll road operator that uses the eFleetPass System and issues, or an entity that does not operate a toll road but issues, passes or other electronic or video tolling products for the purpose of the eFleetPass System.
"Processing Fee" means in relation to a Transaction Summary delivered:
(a) by mail, a fee of $5.00; or (b) by email, a fee of $2.20.
"Rental Agreement" means the agreement entered into between You and Rental Co comprising the documents titled "Rental Agreement" and any other document given to You by Rental Co at Vehicle pick-up.
"Rental Co" means Scooturu Rentals Pty Ltd.
"Rental Co Corporate Account" means a charge account established by a MFA Corporate Account Holder with Rental Co for the payment of the rental of the Vehicle.
"Service Fee" means a fee of $3.5.
"Tag" means the MFA device installed in the Vehicle to enable the payment of Tolls by electronic means.
"Tag Issuer" means a toll road operator who uses the eFleetPass System and issues tags, or an entity that does not operate a toll road but issues tags for the purpose of the eFleetPass System.
"Toll" means all toll charges or other fees and charges imposed by the operator of a toll road for, or taxes payable in respect of, each Trip taken by the Vehicle during the period in which You have hired the Vehicle.
"Tolling Lane" means a lane on a toll road at a toll collection point.
"Tolls and Fees" means all Tolls and Fees and any other payments, amounts or charges referred to in these MFA Terms and Conditions.
"Transaction Summary" means a summary of the transactions (including the Tolls and Fees incurred) on Your eFleetPass Service.
"Trip" means the driving of a Vehicle past a toll collection point.
"Vehicle" has the same meaning given to that term in Your Rental Agreement.
"You" or "Your" refers to the person(s) who have agreed to be bound to these MFA Terms and Conditions and with whom the Rental Agreement is made.
MFA is required to comply with Privacy Laws and other road transport, driver licensing and vehicle registration legislation when dealing with any Personal Information, including eFleetPass Information.
This MFA Privacy Consent and Agreement contains consents and promises from You in relation to eFleetPass Information collected from You and from third parties to enable MFA and others to collect, use and disclose it for Permitted Purposes. You are not required by law to provide eFleetPass Information to MFA, but if You do not, MFA will not be able to provide the eFleetPass Service to You. Your Personal Information will be held by MFA and you may contact us at www.efleetpass.com to access or correct it.
"Agreement Number" means a unique agreement number provided to You by Rental Co or by MFA in connection with the Rental Agreement.
"Associated Contractors" means MFA's suppliers, agents, distributors and contractors in relation to any Permitted Purposes.
"Authorised Information Recipient" means MFA, Rental Co, Your MFA Corporate Account Holder and each Authorised Driver, Authorised Representative and Intended Recipient.
"Clearing House" means any person who operates a clearing house for operators of toll roads, or Tag Issuers or Pass Issuers or any combinations of these.
"eFleetPass Information" means any information relating to You or Your eFleetPass Service, Vehicle, the location of a Tag or Vehicle at any time, the direction of travel, or video and/or camera surveillance operated at toll roads. eFleetPass Information may include Personal Information about:
including a name, address, phone number, email address, drivers licence number, date of birth, Vehicle hire and usage information, billing or financial information, Rental Agreement, Nominated Card, Rental Co Corporate Account, MFA Corporate Account and other Personal Information contained in video and/or camera surveillance of toll roads for traffic management or toll violation enforcement purposes conducted by MFA or obtained by MFA from third parties.
"Individual" means any individual, including any Authorised Driver, Authorised Representative, Nominated Card Holder and MFA Corporate Account Holder.
"Intended Recipients" means the following parties both within and outside NSW: (i) Credit Reporting Agencies; (ii) Associated Contractors; (iii) Tag Issuers; (iv) Pass Issuers; (v) any bank, financial institution or Clearing House; (vi) MFA' professional advisers including legal advisers, accounting advisers and other professional advisers; (vii) driver licensing and vehicle registration agencies, law enforcement agencies, public revenue authorities, road safety authorities and solicitors in relation to motor vehicle accidents; (viii) owners and other operators of toll roads; and (ix) persons providing services to any of the entities set out in (i) to (viii).
"Permitted Purposes" means any one or more of:
"Personal Information" means information or an opinion (including information or an opinion forming part of a database and whether or not recorded in a material form) about an individual whose identity is apparent or can reasonably be ascertained or is reasonably identifiable from the information or opinion and any other information subject to the Privacy Laws.
"Privacy Laws" means the privacy laws which apply to MFA from time to time, including the Privacy Act 1988 (Cth), which includes the Privacy (Credit Reporting) Code 2014 for so long as it applies to MFA and any other current or future legislation, mandatory codes and policies relating to the handling of Personal Information which apply to MFA.
Other capitalised terms in this MFA Privacy Consent and Agreement have the meaning given in the MFA eFleetPass Service Terms and Conditions.
Clause 10 of the MFA eFleetPass Service Terms and Conditions applies to the interpretation of this MFA Privacy Consent and Agreement.
